Terms of Service for MOWD

Welcome to MOWD! These Terms of Service ("Terms") govern your access to and use of the MOWD mobile application and services (collectively, the "Service") provided by MOWD Inc. ("MOWD," "we," "us," or "our"), a Florida corporation. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Account Registration

You must be at least 13 years old and legally able to enter into this agreement. You are responsible for all activity under your account and must keep your credentials secure. We may suspend or terminate your account for any reason at our discretion.

2. Description of the Service

MOWD is a theme park planning app providing tools like crowd calendars, wait times, reopening estimates, day planning, and dining search across major theme parks. New features may be added over time, including the ability to post user-generated content or create business-facing tools.

3. User Content

You may in the future have the option to submit content such as reviews, plans, or comments. You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free license to use, display, modify, and distribute it in connection with the Service.

We reserve the right to review, remove, or refuse to display any content submitted by users if we believe it violates these Terms or applicable law.

4. Acceptable Use

You agree not to misuse the Service or help anyone else do so. This includes not submitting false information, impersonating others, violating laws, or attempting to reverse engineer, hack, or disrupt the Service.

5. Privacy

Our use of your personal information is governed by our Privacy Policy, available at: https://mowd.io/privacy

6. Intellectual Property

All content and software on the Service (excluding your content) are owned by MOWD or its licensors. You may not use, copy, or distribute any part of the Service unless we expressly allow it.

7. DMCA Policy

If you believe content on MOWD infringes your copyright, contact us at support@mowd.io with the following: your name, your copyrighted work, the URL or location of the infringing material, your statement of good faith, and your electronic signature.

8. Termination

We may suspend or terminate your access to the Service at any time, for any reason. You may also stop using the Service at any time. Sections 6, 7, 9, and 11-13 will survive termination.

You remain responsible for any activity or obligations incurred before termination.

9. Disclaimer

The Service is provided "as is." We do not guarantee the availability, accuracy, or uninterrupted operation of the Service.

We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, MOWD Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

This includes but is not limited to loss of data, loss of profits, or business interruption.

11. Arbitration Agreement

You agree to resolve any disputes through binding arbitration in Orange County, Florida, under the rules of the American Arbitration Association. The arbitration shall be confidential and final. Any judgment may be entered in a court of competent jurisdiction.

You waive any right to participate in class actions. You understand and agree that by waiving class actions, you may only bring claims on your own behalf.

12. Governing Law

These Terms are governed by Florida law. Any disputes that cannot be arbitrated will be resolved in the courts of Orange County, Florida.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you via the Service or by email. Continued use of the Service after changes go into effect constitutes your acceptance of the updated Terms.

MOWD provides dining search tools, including listings, descriptions, and filtering options (such as allergy-friendly or dietary preferences). These features are based on menu and ingredient information sourced from restaurants and third-party data providers. While we apply allergy-related filters based on this data, the underlying content is provided for informational purposes only and is not reviewed or verified by MOWD for accuracy, completeness, or safety.

MOWD does not warrant or guarantee that food or menu items listed in the App are free from allergens or suitable for any dietary needs.

You are solely responsible for confirming ingredients, preparation methods, and potential cross-contact risks directly with the food provider before consuming any item.

To the maximum extent permitted by law, MOWD Inc. disclaims all liability for injury, illness, allergic reaction, or death that may result from reliance on food-related information provided through the Service.
