Terms of Use (Terms of Service)

Welcome to MOWD! These Terms of Use ("Terms", "Terms and Conditions", "Terms of Service") govern your access to and use of the MOWD mobile application and related services (the "Service") provided by MOWD Inc. ("MOWD," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility and Accounts

You must be at least 13 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We may suspend or terminate accounts where permitted by law, including for violations of these Terms or misuse of the Service.

2. Description of the Service

MOWD is a theme park planning and informational tool that provides users with access to wait time estimates, dining information, crowd trend data, estimated attraction reopening insights, and optional trip planning tools. All information is provided for reference and decision-support purposes only. MOWD does not direct guest behavior or guarantee outcomes.

3. End User License Agreement (EULA) and App License

These Terms include an end user license agreement ("EULA") that applies to the MOWD mobile application (the "App"). The App is licensed to you, not sold.

3.1 License Grant

Subject to your compliance with these Terms, MOWD Inc. grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use the App for your personal use (and, if applicable, internal business use) on devices that you own or control.

3.2 Usage Rules

You must use the App in accordance with applicable laws and the usage rules and terms of the platform from which you download or access the App (for example, the Apple App Store or Google Play).

3.3 Restrictions

Except as expressly permitted by applicable law, you may not (and may not permit others to):

  • copy, modify, or create derivative works of the App;
  • reverse engineer, decompile, or attempt to derive the source code of the App;
  • distribute, sell, rent, lease, lend, or sublicense the App;
  • remove, alter, or obscure any proprietary notices in the App; or
  • use the App in a manner that violates these Terms, infringes rights, or circumvents security or access controls.

3.4 Updates, Changes, and Availability

The App may update automatically and may change over time. We may add, modify, suspend, or discontinue any part of the App or Service at any time, subject to applicable law. If you do not install updates, the App may not function properly.

3.5 Maintenance and Support

We may provide maintenance and support for the App at our discretion. Platform providers (including Apple and Google) have no obligation to provide maintenance or support services for the App.

3.6 Third-Party Beneficiary (Apple)

If you downloaded the App from the Apple App Store, you acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

3.7 Export and Sanctions

You may not use, export, or re-export the App except as authorized by applicable law, including U.S. export control and sanctions laws and the laws of the jurisdiction where you reside or use the App.

4. Account Identifiers and Conduct

MOWD is a private, personal planning tool. Any information you enter into the app—including your username, trip plans, or notes—is for your individual use only.

  • No Public Display: The Service does not include social feeds, public profiles, or user-to-user communication. Your username and data are not visible, shared, or accessible to any other user.
  • Zero Tolerance for Objectionable Content: While your account information is private, you agree not to create account identifiers (usernames) that are offensive, lewd, abusive, or illegal. MOWD maintains a zero-tolerance policy regarding such content.
  • Moderation and Reporting: MOWD reserves the right to remove or rename any account that violates these standards. Any concerns regarding account safety or objectionable identifiers can be reported to support@mowd.io and will be addressed.

5. Prohibited Use

You agree to use the Service only for its intended purpose as a personal planning tool. You are prohibited from:

  • Attempting to circumvent the Service’s security or accessing other users' private accounts.
  • Using the Service for any illegal activities or to misrepresent your identity.
  • Automating the Service (e.g., using bots or scrapers) without express permission.

6. Acceptable Use

You agree not to misuse the Service, including attempting to access systems without authorization, interfering with operations, violating laws, or misrepresenting information.

7. Subscriptions and Payments

MOWD may offer certain features as part of a paid subscription ("MOWD Premium"). Subscription options may include recurring monthly or annual plans (where available). If you purchase a subscription, it will auto-renew unless cancelled in accordance with the applicable store’s policies.

Billing and Renewal. Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase. Your subscription will renew automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account may be charged for renewal within 24 hours prior to the end of the current period.

Managing and Cancelling. You can manage or cancel your subscription at any time through your Apple App Store or Google Play account settings. Deleting the App does not cancel your subscription.

Refunds. Refund requests are handled by Apple or Google (as applicable) under their refund policies. MOWD cannot issue refunds for purchases made through the App Store or Google Play.

Access to Premium Features. Access to MOWD Premium features is provided while your subscription is active. If your subscription expires or is cancelled, Premium features may be restricted.

8. Privacy

Your use of the Service is subject to our Privacy Policy, available at https://mowd.io/privacy.

9. Intellectual Property

All software, content, and materials within the Service (excluding user-submitted content) are owned by MOWD or its licensors and are protected by intellectual property laws. No rights are granted except as expressly stated.

10. Third-Party Data and Services

Certain features rely on third-party data providers or services. MOWD does not control, verify, or guarantee the accuracy, availability, or completeness of third-party data and is not responsible for changes, interruptions, or errors in such data.

11. Termination

We may suspend or terminate access to the Service at any time. Sections related to intellectual property, disclaimers, limitation of liability, and dispute resolution will survive termination.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. MOWD disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable law.

13. Food, Allergy, and Dietary Disclaimer

MOWD provides dining search tools, including listings, descriptions, and filtering options (such as allergy-friendly or dietary preferences). These features are based on menu and ingredient information sourced from restaurants and third-party data providers. While we apply allergy-related filters based on this data, the underlying content is provided for informational purposes only and is not reviewed or verified by MOWD for accuracy, completeness, or safety.

You acknowledge that MOWD does not warrant or guarantee that food or menu items listed in the App are free from allergens or suitable for any dietary needs.

By using the allergy feature, you expressly acknowledge and agree that you are solely responsible for confirming ingredients, preparation methods, and potential cross-contact risks directly with the food provider before consuming any item.

To the maximum extent permitted by law, MOWD Inc. disclaims all liability for injury, illness, allergic reaction, or death that may result from reliance on food-related information provided through the Service.

You specifically waive any and all claims, liability, and/or damages against MOWD resulting from the use of the allergy feature.

14. Limitation of Liability

To the maximum extent permitted by law, MOWD Inc. shall not be liable for indirect, incidental, consequential, or special damages arising from or related to your use of the Service.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

15. Arbitration and Class Action Waiver

Any disputes arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in Orange County, Florida, under the rules of the American Arbitration Association. You waive any right to participate in class actions or representative proceedings. Where arbitration or the class action waiver is prohibited by applicable law, those provisions will not apply to you.

Nothing in these Terms limits any consumer rights that cannot be waived under applicable law, and dispute resolution terms apply only to the extent enforceable in your jurisdiction.

16. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

17. Trademark Notice

MOWD is not affiliated with, endorsed by, or sponsored by The Walt Disney Company, Universal Parks & Resorts, SeaWorld Parks & Entertainment, or any other theme park operator.

18. Changes to These Terms

We may update these Terms periodically. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
